Nintendo Sues Over Premature Switch 2 'Mockup' Reveal

Nintendo has initiated legal action against accessory manufacturer Genki, alleging trademark infringement following Genki's release of renders depicting a "mockup" of the Nintendo Switch 2 months before Nintendo officially unveiled its new console. The controversy erupted at CES 2025 in January, where Genki showcased the Switch 2 mockup, claiming it was based on a real Switch 2 system they had seen and used to develop their accessories.

According to court documents obtained by IGN, Nintendo accuses Genki of launching a "strategic campaign" to exploit public interest in the next-generation console. The lawsuit includes charges of trademark infringement, unfair competition, and false advertising. Nintendo argues that Genki's claims of early access to the unreleased console and their assertions about accessory compatibility are misleading, as such guarantees would require unauthorized access to the Switch 2.

The legal papers state that in January 2025, Genki began advertising that it had unauthorized access to the upcoming Nintendo Switch 2, which had not yet been publicly revealed. Despite later contradicting their initial claims about possessing a console, Genki continued to assert that their accessories would be compatible with the Switch 2 upon its release.

A tweet from Genki on January 20, featuring CEO Edward Tsai with a finger to his lips and the caption "Genki ninjas infiltrate Nintendo Kyoto HQ," along with a website pop-up saying "Can you keep a secret? We can’t...," drew additional ire from Nintendo.

Nintendo is seeking to prevent Genki from using the "Nintendo Switch" trademark in its marketing, demanding the destruction of any products or marketing materials referencing Nintendo's branding, and requesting unspecified damages, which it hopes to have tripled.

In response, Genki issued a statement on social media over the weekend, acknowledging the lawsuit and expressing their commitment to addressing it seriously with legal counsel. They emphasized their independence and dedication to creating innovative gaming accessories, reaffirming their product quality and originality. While unable to comment in detail, Genki confirmed they are preparing to fulfill orders and showcase new products at PAX East. The company thanked supporters and reiterated their focus on building gear for gamers.

The Nintendo Switch 2 is scheduled to debut on June 5, with pre-orders starting on April 24 at a price of $449.99. Pre-orders were met with high demand, prompting Nintendo to warn U.S. customers applying for pre-orders through the My Nintendo Store that release date delivery is not guaranteed.
